Affiliate Terms and Conditions

Because of the Horse Affiliate Program

Terms and Conditions

Enrollment in the affiliate program by Because of the Horse, hereinafter referred to as “Because of the Horse,” is subject to the following terms and conditions.

By using any affiliate links provided by Because of the Horse, you agree to all terms and conditions of this affiliate program.

Obligations of the Parties

a) The Affiliate shall have the opportunity to promote Because of the Horse, Art of the Horseman, and other programs and events in accordance with the terms of this Agreement.

b) The Affiliate shall promote and market programs using promotional materials that are not false or misleading.

c) The Affiliate shall direct potential purchasers to the dedicated affiliate links provided by Because of the Horse.

d) The Affiliate agrees to conduct itself in compliance with all applicable laws, rules, and regulations, including, without limitation, CAN-SPAM.

e) The Affiliate acknowledges that all referrals will be added to the Because of the Horse email list and may receive future educational content and promotions.

Compensation

Because of the Horse will pay commissions from the sale of products as follows:

VIP Lifetime Ticket

  • Presenter Affiliates: $48.99 per VIP Lifetime Ticket purchase

  • All Other Affiliates: $24.49 per VIP Lifetime Ticket purchase

Each Affiliate is required to use the affiliate link provided in advance of promotion in order to enable proper tracking. Commissions cannot be paid if the Affiliate fails to use the correct link.

Commissions are paid on revenue received, net of short-term returns. Commissions will be paid within thirty-five (35) days of completion.

Tracking

These are our current practices:

  • Cookies are set to expire after 30 days. Affiliates are encouraged to share their links regularly to ensure continued tracking.

  • Commissions are paid to the last referral of record for the buyer.

  • When retargeting ads are run during a launch, they do not replace the last referring affiliate. If a referred customer completes a purchase through retargeting ads, the original affiliate will still receive credit.

Confidentiality

a) None of the parties shall, during the term of this Agreement or at any time thereafter, communicate, divulge, or use for the benefit of any other person or entity any confidential information, knowledge, or know-how of another party. Such information may be disclosed only to employees, financial advisors, or legal representatives who must have access to fulfill obligations under this Agreement. All parties shall take necessary precautions to ensure confidentiality.

b) The parties shall remain independent contractors. Nothing in this Agreement shall constitute any party as an agent, legal representative, partner, employee, or joint venturer of another. Affiliates shall not represent themselves as agents or representatives of Because of the Horse.

Termination

a) Either party may terminate this Agreement with thirty (30) days’ prior written notice.

b) Because of the Horse may terminate this Agreement immediately for cause, including but not limited to:

  • Conduct by the Affiliate that detracts from the reputation of Because of the Horse or its programs

  • Consumer complaints regarding the Affiliate

  • Misuse of the names or images of speakers or faculty associated with Because of the Horse programs in a manner inconsistent with branding, goals, or intent

  • Any deviation from professional or commercial standards

  • Breach of any terms of this Agreement by the Affiliate

Indemnification

This Agreement sets forth all terms of the Because of the Horse Affiliate Program.

The parties agree to save and hold each other and their respective corporate affiliates harmless and to indemnify each other against any and all losses, liabilities, damages, judgments, awards, suits, claims, fines, penalties, and expenses, including reasonable attorneys’ fees, arising from:

a) Any acts or omissions by a party or its agents, servants, or employees in connection with performance or failure to perform under this Agreement
b) Any breach of representation, warranty, or covenant herein
c) The sale, marketing, advertising, or promotion of Because of the Horse programs
